2. Where This Privacy Policy Applies

This Privacy Policy applies to websites, apps, events and other services we operate under the hubiVue brand. For simplicity, we refer to all of these as our "services" in this Privacy Policy. If some services require their own unique privacy policy, then that policy -- not this Privacy Policy -- will apply.

3. Information We Collect

It goes without saying, we can't help you create home automation dashboards without some information about you, such as basic profile details and the details of your home. We also collect information about your use of our services such as access logs, as well as information from third parties, like when you access our services through your social media account or when you upload information from your social media account to complete your profile. When you create an account, you provide us with at least your name and email address, as well as some basic details necessary for the service to work, such as your home automation technical details.

When you complete your profile, you can share with us additional information, such as details about your home, as well as content such as photos and videos.

To add certain content, like pictures or videos, you may allow us to access your camera or photo album.

When you purchase a subscription, you provide our third-party service provider with information, such as your debit or credit card number or other financial information.

If you contact our support team, we collect the information you give us during the interaction.

If you share with us information about other people, (for example, if you use contact details of a guest or friend for a given feature), we process this information on your behalf in order to complete your request.

4. How We Use Information

The main reason we use your information is to deliver and improve our services. Read on for a more detailed explanation of the various reasons for which we use your information, together with practical examples.

To manage your account: to manage your registration as a user of the service. The personal data you provide can give you access to different functionalities of the service that are available to you as a registered user.

For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services you have purchased or of any other contract with us through the service.

To contact you: To contact you by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation. To provide you with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information.

To manage your requests: To attend and manage your requests to us for support, assistance or any information you need from us that we can reasonably provide.

For business transfers: We may use your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by us about our service users is among the assets transferred.

For other purposes: We may use your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our application, products, services, marketing and your experience.

5. How We Share Information

Since our goal is to help you build home automation dashboards for use by you and your guests, the sharing of users’ information is, of course, with other users of the service.

With other users: You share information about your home with other users when you voluntarily disclose information on the service (including your activity at home). Please be careful with your information and make sure that the content you share with guests is stuff that you're comfortable being visible.

For business transfers: We may share or transfer your personal information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

With business partners: We may share your information with our business partners or service providers to offer you certain products, services or promotions, and to monitor and analyse the use of our service.

With law enforcement / when required by law: We may disclose your information if reasonably necessary; (i) to comply with a legal process, such as a court order, subpoena or search warrant, government / law enforcement investigation or other legal requirements; (ii) to assist in the prevention or detection of crime (subject in each case to applicable law); or (iii) to protect the safety of any person.

Use and share of non-personal information: information that, by itself, does not identify who you are such as device information, home automation devices, dashboard usage and configuration data, general application behavioural data, geolocation in de-identified form etc, may also be shared with third parties or used by us to better deliver our service to you and to help inform our development and engineering efforts.

6. Cross-Border Data Transfers

Sharing of information laid out in 5 above may involve cross-border data transfers to Australia, the United States of America and other jurisdictions that may have different laws about data processing. When we transfer personal information outside of other countries which data protection laws have been deemed adequate by a competent governmental body, we use standard contract clauses (standard contractual clauses are commitments between companies transferring personal data, binding them to protect the privacy and security of your data) or other appropriate transfer mechanism.

7. Your Rights

We want you to be in control of your information, so we want to remind you that you can always delete and close your account with us, and remove your personal information at anytime. This can be done either within the mobile application, or by contacting us.

Keep in mind, we may reject requests, including if we are unable to authenticate you, if the request is unlawful or invalid, or if it may infringe on trade secrets or intellectual property or the privacy or other rights of someone else.

8. How Long We Retain Your Information

We keep your personal information only as long as we need it for legitimate business purposes and as permitted by applicable law. If you decide to stop using our services, you can close your account. Note that we may close your account automatically if you are inactive for a period of two years. After your account is closed, we will delete your personal information, unless we are required by law to retain information (for example for tax or financial reporting reasons, or legal action/disputes) or for any legitimate business purposes that not doing so would cause unfair harm or loss.

Because we're always looking for new and innovative ways to help you build home automation dashboards and making sure explanations about our data use remain up-to-date, this policy may change over time. We will notify you before any material changes take effect so that you have time to review the changes.
